This is a very good PDF on USCIS website..AILA has many rights to demand explaination from USCIS...they do ask questions about EAD extension etc...
We should figure out a way by which AILA demands answers from USCIS regarding using the 140K wasted visas because of slow processing...

Certainly the layoffs have been on the steady rise since last quarter of 2008. Most layoff's i have heard were either in Oct 2008 or Feb/Mar 2008 and mostly for contractors.
So layoff's are definitely happening, but a lot of full-time emplyoyees are doing better than those in contracting.
in my area i have seen around 350 contractors laid of by a insurance company and also downsizing in the state workforce.

USCIS reverses its rule. I-485 can now be submitted without medicals. RFE will be sent for that.

Guysssssss N Gals , I got it (I-485 approval) 10 minutes ago!!!!!!!!!!! NO RFE. Recent Luds were on I-140 / I-129 / I-131 ( Luds occered on 10/29 & 11/4) . Been in USA (F1, H1) since Aug 1997.

Checking visa documents before issuing License is one thing. Changing the shape and character of the ID to brand a person “different” is another and purely discriminatory and bad in taste.
It is like wearing a band on your sleeve with “Immigrant on H1” or “Immigrant on EAD” written so that all the people one interacts with can know that.
DL is an ID used on daily basis by people – from airport, to get loans, to get insurance, and sometimes even to buy items on credit card.
Visa status is of no business to any one except Immigration or may be law enforcement authorities.
Give license for the date as long as the visa is valid. Sounds okay. But discriminatory branding of a person's status via his ID is not just an immigration issue; it is a human rights issue. These kinds of laws are more insidiously un-democratic and discriminatory than it may initially look like.

There is no such thing as a cooperative employer in this economy. I will give you an example, recently in my wife's company they had advertised for a genuine job and on the first day they recieved 200 applications!!!!!!!!!!!!!!!!!!!!!!!!. The hr after one week has not been able to review just the first day responses. because of situation like this no company is willing to even file for eb3 labor leave alone eb2. Because they cannot justify a perm labor when they are recieving dozens if not hundreds of resumes. It is because of situations like this that labor department is becoming stricter and stricter by the day. The post below seems to suggest even if you get audited you will get approved in 1.5 to 2 years. In this environment where unemployment is rampant there is very little chance of success in getting perm approval even in eb3 so dont be under any illusion that no matter what perm would be approved. It will not be approved under current market conditions because of hundres of resumes to perm advertisemsnts. it is because of this reason that a vast majority of companies have decided not to sponsor green cards. there is no such thing as a "coperative employer" in this economic conditions. Companies are being forced to send employees away from US because there 6 years of h1 are comming to an end and they are not able to file green card in this economic conditions.
OP - If you have a cooperative employer, I would say go for it. Given the rate at which EB2-I is progressing, you will get GC much sooner although the PERM process for EB2 may take a long time. Assuming you get an audit on your PERM, even if the entire process takes 1.5 years, you can get your 140 in PP and once your PD is ported, you are current. Even if the entire process takes 2 years (worst case), it's worth the effort. EB3-I will move at a very slow pace. As others suggested, you wont see significant movement till EB2-I is current.
Financially, the porting would make a lot of sense too. Assuming a family of 2, you are spending close to $1000 (or even more) per year on the AP and EAD renewals, not to mention the employer's cost of renewing the H1. When you go to your HR for starting the EB2 process, you want to put it in terms of how it's financially viable for the company. When you do the math, it's a win win for both the employer and the employee in the long run if you get the GC earlier.

Also, I commute to US everyday to work, which is less than an interval of 12 hours.

Having said that, typically, trips outside US that lasts less than 24 hours are not counted. That way, daily trips could be OK. However, may I ask, where do you spend your weekend?
It comes down to this question. Are you residing in US? The burden of proof is on beneficiary (I-485 applicant).
I would suggest that you should consider getting second opinion from a reputed attorney.

I don't know much about Canada PR, but the 2nd option sounds good to me. Make sure your new employer is willing to give you a Joining Letter with the similar job responsibilities, job title, etc upon which your 485 is based.

Friends I want to point out a few things. But before that Wanted to let you know that Diwali is my major festival too and I celebrate Diwali with great respect. I do not think the importance of Diwali will get diminished in the heart of people irrespective of the fact they are mentioned in media.
However, I do not understand why we are discussing whether Diwali is mentioned in Google or on some media. Google inc is a business organization and they will do whatever they feel is good for their business. Only their shareholders can dictate them. If we are not the major shareholders then why are we bothered. They would write about Diwali if they like. Why we should try to press our religion over others. Everyone should be free to follow their own. Else we will become part of the religious fanatics.
Secondly this is an Immigration forum. If I remember IV is for all immigrants in USA and not just for a particular country(origin) or religion. These type of discussion will try to create division amoung us the immigrants who are from all religions.
Actually I just wanted to point out the generic indifference shown towards the feeling of people of India by mainstream western media and governments - the long wait in immigration queue and ignoring the plight of Indian legal immigrant aspirants , setting a per country quota ignoring its population representation is just an extension of the same mentality... and I also wanted to point out how this mentality of deliberately ignoring Indian feelings and values is going to become increasingly irrelevant in the changing world where BRIC countries will wield increasing power.

That's just it; isn't it. I'm here legally paying taxes, immigration and all that other good stuff. This last year many illegals who filed 2006 taxes and were awaiting refunds did not get the refunds due to their immigration status! Many things are on the change and when 4 of you are on TIN#'s it is easy to get pulled. What they audited us for was stupid totally illogical! Prove we were married, that the kids lived with us and we lived together in same house. That was it. Why would you file jointly if you did not live together in the first place. IRS office confirmed, then 2nd one re-confirmed it was flagged by INS and it wasn't even hidden well. So, that was August and we filed 07/05 the audit was for 2005 returns. They have all paperwork, but haven't heard anything back yet. That is a good thing too. I crammed every bit of evidence I could into that sealed file before sending it off. The officer who confirmed receipt of it was laughing harder with each turn of the 50 odd documents of proof that I had sent. She said I don't think we can deny that you live together and the kids live with you!!! Please don't worry about it. You should receive a letter in about 30 to 40 days with the outcome.
That is it and I shall wait for the letter to arrive signing it off.

Working in the accounting/financial industry, I have to deal with the IRS time to time. From my experience, I can tell you that IRS care about their customers and if you say something, they will actually listen to you. Their customer service is actually pretty helpful.
After all you have provided them, if they still cause you more trouble, hire a local CPA and the CPA will work with you to resolve any issues with the IRS. CPAs are usually less expensive than lawyers.
Hearing your case, it sounds to me that your's was just a random case. I don't think they will bother you anymore. Good luck.

You may be right. But with your logic all these talk about opening an SR, getting an infopass and blah blah is not right then. We have polls here on what worked....that's what i was telling it is too much of a coincidence. Opening an SR won't make a sick IO healthy and come back to work..taking an infopass won't bring a dropped out file back in the pile...talking to senators and congressman are useless anyways....
So bottomline is all this talk about what works or not is a pure guess and nothing else....USCIS has always been a black box and will always be..

Buddy, what were you doing for 40 days after your got terminated? If you knew it was coming you should have made efforts to transfer H1 or right after. If you transfer H1, then obviously INS will look for pay stubs etc from the last sponsoring co. Since you mentioned you never actually worked for them (if I understand this right) then you are in trouble. You can use EAD but you lose your H1 status. If you want to get back to H1 then you are back in the lottery mess to qualify for one. Obviously you need to decide what is important to you at this point. Marriage or your job/GC. Good luck.
I was in India and didn't know about it. As soon as I came to know I was under the impression it was easier to switch back and forth between EAD and H1 except that I may have to go to the consulate for visa.

NO, it is not normal. My lawyers recieved the denial notice in a weeks time and they had told me that they would contact USCIS if they did not get the notice in 14 days.
Even my AP got approved on april 22nd and it was mentioned in status that the approval notice was sent on april 22nd. But again they updated the same info on May 1st.Still i havent recd the approval notice.

Like this lot of bills will be introduced between Jan to Dec and nothing will happen.Any immigration bill pro or anti will have tough time to pass. Generally Anti immigration will not come under consideration. Pro-immigrant bills will be considered but it will be blocked or no agreement will be reached as usual. We have to see this year. President wanted CIR not because of Welfare of immigrants but for repairing the damage caused by Iraq Mess. The problem is
Pro-immigrants are asking too much. Anti Immigrants are not willing to give anything. There is no one was trying to negotiate. Everyone wants scuttle the moves of others by politics. Instead if both anti immigrants and pro immigrants in the congress negotiate and form a compromise the bill can be passed easily. But the bill should be for the country not for one group of people.
