There were about 600,000 AOS applications including the July and August filers. So that number less 60,000...roughly about 540,000 applications still pending with USCIS....
And 540000 @ 140000 per year is approx. 4 years!

Again, my assumption is even distribution which is not a reality. I filed mine on May 12 and sent to Phoenix Lock box and had the same issue. My checks are not cashed and am going through the same pain as you do. My lawyer suggested its not unusual to have these delays and it could take upto 4 weeks for the receipt notice to come. I am still tensed as the checks are not cashed and there is no receipt for the renewal. Please let me know how you are proceeding or find any new info

PD for family based visa is based on the date you file your I-130 for your Spouse. Nothing to do with the Labor certification.
For unmarried sons and daughters of GC holder same PD is given as of parent - I saw couple of documents.
I am not sure about (2A) cases.

I am stuck in EB3 and want to apply for EB2. How does one find companies willing to do EB2? With desi consulting companies you can ask upfront to the recruiter but with american companies can you do the same?

I dont think that revoking I-140 by sponsoring employer has any affect on the your process if you use AC21 after 180 days...Not sure about the before 180- days situation though !!:rolleyes:

That is equivalent of approx 22 miles. I doubt there is anybody is bombay that drives 35 km one way on a daily basis. But in the US living 10-20 miles from work is not bad. People in my office drive about 40 miles one way without blinking an eyelid. Some drive even more. Plus the cars that they have in india have smaller engines, smaller capacity thereby better gas mileage.

I received IRS tax audit check for year 2005 last week. I guess mostly I can defend my audit and I have scheduled an appointment with IRS tax manager for next week
However god forbid if I have to pay penalty on audit,I was wondering this would impact anything on my 485 process. Does it have any impact

You mean to say CIR will be introduced to the immigration or judiciary senate committee or introduce directly to the senate. If it is introduced directly to the senate floor that will save a lot of time, on the flip side it will become difficult to add or change provisions if it is directly introduced to the senate bypassing the senate judiciary and immigration committee

I completely disagree..There is this huge debate in IV about EB2 & EB3 IN. Everyone is looking at the dates and predicting that EB2 I will be current sometime in '09. This is perceived as injustice to EB3. What people don't realize is that USCIS is not processing. What good is a forward movement if there are no tangible benefits for folks who have already filed AOS.
Forward movement in Sep VB magnifies the USCIS inefficiencies. Despite the rhetoric on the board, this is -ve development in my view. Empirical evidence suggests that there are 1000s of cases pending for pre 06 EB2I & C and yet USCIS could not get that back log cleared. They obviously could not process enough to exhaust the available visa numbers and thus the forward movement by DOS.
This bodes well for CP filers…good for them.

When you join a medical residency on J1 visa, you are subject to 2 years home residency requirement (HRR) before you can apply for green card. What that means i s you have to go back tou your country for 2 years BEFORE you are eligible for any other kind of visa or change in status. You wont be be able to apply for i-485/EAD/ green card even if your husband gets his in the meantime if HRR is not satisfied
The ONLY way to get around the HRR is to sign a contract to work in an medically underserved area for 3 years (on H1b). Once your 3 years are over, you can then apply for GC by what ever means, work or family.
Overall doing residency on J1 is easier as you dont need to clear USMLE step 3, there are more opprtunities as more programs offer J1 positions. Also, if you want to do fellowship, there are more programs in all specialities which will offer J1, not H1. Also, you dont pay medicare or social security tax on J1 which means more money. On the other hand after completing your residency/fellowship you will have less job opportunitis as you will have to find an employer who falls in a geographically underserved area. PM me if you need any more info.

You may belittle it by calling it a joke but to me it is critical because this issue may turn into a trade issue. Call for negotiating a comprehensive services agreement is not mundane. Together with rejection of billions of dollars worth Us defense deal, this is seriously moving towards becoming a significant issue. You may want to dot the is and cross the ts but that is not how the Law makers, Senators US or Indians think about these issues. They are at 30K feet level looking at the Forest while we waste time in just going around our own trees.
To me the intent is more important than the content in the early stages. We will get to details once there is broad agreement on the issue, that is basic negotiation 101.
