For people thinking canada, or H1 b with children, what should I tell them.
Go to canada no job, will not be able to keep familiy there. Don't tell me people are not able to find a job in US in this market.
It is up to people to think of Canada or india. India is faaaaar better.
More jobs, very well paying.. own house and family..

I am a highly-skilled professional who entered this country legally. I�ve been waiting for my US permanent resident visa -also known as "Green Card" for the past several years along with 500,000 other educated, highly skilled employment based (EB) immigrants. Many of us have been waiting for our turn to get Green Cards for 5-10 years while consistently abiding by all the laws of this country. Such long delays are due to tortuous and confusing paper work, backlogs due to various quotas and processing delays at US Citizenship and Immigration Service (USCIS) and other allied state and federal agencies.
Several categories of EB immigrant visa (Green Card) numbers have been unavailable (�retrogressed�) since the fall of 2005. Because our immigrant petitions are tied to the sponsoring employer, these delays have led to indentured servitude for several of us. Our professional prospects, job mobility and potential opportunities for entrepreneurship have been compromised.
For the past several decades, the US Department of State (DOS) has been publishing advisories known as visa bulletins once a month to announce the availability of immigrant visa numbers. On June 13, 2007, after a gap of nearly two years, DOS announced that all EB visa numbers would be �current� for the month of July. This meant, irrespective of our �priority date� (date assigned to us for our turn in the line for Green Cards), all of us were made eligible to apply for some interim immigration benefits. This �priority date� refers to the date when our labor certification (documentation verifying no US citizen worker was available for a given job) had been filed.
Please note that 6/13 DOS announcement would not have led to immediate green card for most of us; but at least it would have ensured us interim benefits such as the right to travel and right to work- this was still a welcome change. Especially, for dependent spouses who have been otherwise unable to work, this would have translated into right to travel and work without restriction and thus channel their energies positively. Several dependent spouses are also highly-skilled. This would provide them an opportunity to realize their technical and entrepreneurial expression and add to tax dollars. Additionally, this would have greatly reduced the paperwork burden on our sponsoring US employers.
Tens of thousands of applicants spent thousands of dollars in legal fees, immigration medical exams & vaccinations & getting various supporting documents ready to file our immigrant petitions to USCIS, at times inconveniencing our old parents in our home countries as well. It has been an agonizing two weeks for us. Some of us to had to fly in our spouses from our home countries or have had to cut short business trips. To our shock and dismay, on the morning of July 2nd 2007, USCIS announced that EB visa numbers were not available and all petitions filed in July would be rejected.
For the legal skilled immigrants this has been a rather traumatizing and disheartening experience.
We sincerely seek immediate congressional/ legislative remedial measures which would
(1)Reduce the enormous backlogs of green card petitions of legal skilled immigrants
(2)Ensure and request USCIS not to reject our immigrant visa petitions filed in July and provide us interim benefits of a pending immigrant visa petition. We make this sincere request on this Independence Day with the hope that people who played by the rules will be rewarded.

Folks,
It is worth trying but from my experience over the last 3 years of contacting congressman's office....it really is not that important.....I have heard that the congressman needs to be influential et al...that's nonsense...the congressman never gets to read ur mail...it goes to an immigration person mostly a junior staff member and he does what lawyers do thru AILA to get info on the case...they can neither expedite a case nor get valuable information for you...

But, there is an outside chance that one of the retrogressed is related to one of them or somebody knows a politician... and our e-mail also reaches them at the perfect time! And, one of the concerned politician/minister happens to meet one-on-one with Karl Rove, or any such powerful figure in the Bush Team! And, they bring it up with the Bush Team, who assure them they will make Retrogression disappear!!!

1. you can files your I485 and later add your spouse if the dates are current or you have the priority date.
2.You can apply for EAD during I485 and at the same time can be on H1 unless you don't change an employer using EAD.
3.Unless you add your spouse to I485 process..you have to maintain your H1 status as your spouse will be on H4.
4.BY any chance your I485 is approved before adding your spouse(present in US)..you have 180days to apply for your spouse.
5.If your I485 is approved when your spouse in outsite USA..then you have to go for consular processing.
6. No one exactly knows if the PD will remain same or not.
So anyone about to marry or planning to get married,talk to your attornies about your situation and take a decision.

I surely may have missed something here. Has been a bill placed already that will allow us to file 485 and get EAD?
Sorry, I am really having tough time coming to IV these days.
Its law the day when it is signed by the president unless there is clause in the bill to postpone the impelmentation.

What do you mean by "new system"?
If you want to wait until approval, file H-1B premium. If you have skills and its "bonafide job", not much risk for H-1B denial. Note, H-1B visa is not for speculative employment.

What specific action by a congressman has to be taken which section of the law has to be modified in what exact wording should be. Many people say about issues and plight but what exactly has to be done and where and by whom. Sorry if I still missed the info other than the one you gave in the link

how about a chance for a free giveaway, like a 15 minute session with a lawyer for free. This could be done in 2 ways.
Referral mode: For every x member that any existing member brings in, he/she gets x minutes with the lawyer for free.
Sweepstakes mode: Every new member coming has a chance to get y free minutes with the lawyer. Make this y a bigger than x.
I am guessing, there will be lotsa people who would like to consult immi lawyers with their immi questions, and a free consultation would be a sufficient motivator :)
