There is a laundry list of things which are all good. Unfortunately I dont see anything realted to the ability to file 485 when priority date is not current.
I guess it does not matter since this never passed. I can only hope that this does not become a trend and 485 measure is forgotten

I like this plan of mine better than the runners world plan. Please see below if you are looking to run. This plan is tailored for a beginner.A friend of mine shared this with me like 6 years ago. She actually calls this plan a Couch to 5K plan :D. This plan recommends you run 3 times a week. so choose your 3 days with a day of rest in between.
Week1 - Walk 4 mins, run 1 minute ( repeat this 6 times = 30 mins)
Week2 - Walk 3 mins, run 2 mins (repeat this 6 times = 30 mins)
Week 3 - Walk 2 mins, run 3 mins(repeat this 6 times = 30 mins)
Week 4 - Walk 1 min, run 4 mins(repeat this 6 times = 30 mins)

The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.
Ever since retrogression started the dates have not crossed 2001. 245i or not, the backlog is a fact. Sad part, when there is action items from IV, trying to talk to my state members, I have realized and been told that IV does not cater to EB3 anymore. It is disheartening how much ever I try to explain, occasional members look at IV threads like EB2-EB3 predictions and say there is no hope for EB3 and also IV has no answer to it.
I tried my part...too bad I was not able to participate in the IV advocacy day due to family emergency. anyway, let us hope IV's persistence yields us the results. My heart goes for a lot of EB3s who may automatically qualify for EB2 just due to their experience.

You are hearing utter nonsense from your friends. They have no inclination to find out the truth or wish to take part in the action item. Such armchair strategy folks are the reason we are all suffering in EB3 I. If these folks joined this effort and worked hard to fix it, we would have made lot more progress. Despite being highly educated, some people fall prey to divisive posts and opinions on the forums without checking the facts.
People who had come to the DC advocacy day this month know what we do and that our focus is solving EB retrogression completely. We do not talk about EB2 , EB3 categories. We talk about the overall retrogression in EB visas.
The biggest damage and threat to this effort is not from anti-immigrants or other interest groups but from people of our own community who spread lies, pursue personal agenda and grudges, talk against this effort and cause damage to this community effort. They forget that this damages their own cause. Have you seen divisive posts, or anti-organization posts on the forums of anti-immigrants? Just think about it.
After leading this effort for more than 4 years I have come to a realization that we as a community are the reason of our own failure and the reason for our own successes. There is nobody else to be blamed. If we have to blame someone for this broken system, it is ourselves for not being able to get together and fix it.

Thanks for your support Needhelp! I really hope you can come walk the 5k at the Houston event. As I said before, the 5K is a 45 min walk at a moderate pace. And like Santb1975 said, you can reach a goal of 5K in 6-8 weeks.

Everyone please three cheers for these girls.
Kanika: She was working with her one year old or may be less than a year kid in one hand. By the way her kid was helping her to to hold the phone and her another hand was holding the apointment document and pen.
Niloufer: She came to IV situation room for the first time. Her daughter was with her husband. We were running short of people and had lot of things to do. I was the one who did not even ask whether she is ok to do some work on that day. Sorry for that Niloufer but you are wonderful person.
Meenal: After working for three whole days, she was without even thinking about herself kept looking for my laptop. My company would have fired me if they would have found that I have some company data in the laptop which is lost. But fortunately I found my laptop. You were on the top of it and were very determined to find my laptop. Thanks for all your help
Sumita: Oh man, she speaks a lot. But let me tell you one thing. Without her help we would not have the successfull "Meet the Lawmaker day". We had 100+ meetings arranged on Monday. She made sure that our members attend each of these meetings.
Nili: She had a broken ankle but was on her feet from day one. She took care of each of the CA members and made sure that they meet each of the CA lawmakers in DC.
Tamsen: I think she have never said "NO" in her life. I think in her dictationary there is the word "NO" is not listed. We kept assigning lot of the task to her and she kept doing it.
Your dedication to IV is the real strength of IV.

At the same time, i know folks who have got their GCs applying after me, because they could (apply) in another category. i only feel Happy about them.
My question is not why they could get it before me, but What reasons USCIS may accept to ease up the queue for us all. It does not seem probable, that they will ease it up all at once. If a certain group is not subjected to the quota - say PhDs (although i do not qualify), it will help my cause as much as others in the wait.

My suggestion is: those who have maxed out their 6 yrs on H-1B + have atleast crossed the labor and I-140 stage; should be automatically granted the green card.
These are the people who are really stuck, because if their green card does not get approved, they have no option but to return. Also, if they lose their job they are out of options as they cannot seek another H1B extension or transfer.
Typically, these people would have young children who were born here, and go to school here. These children sing the US national anthem and pledge allegience to the flag everyday at their school. Making these people wait and wait for their green cards helps no one. They are not taking anyones jobs, they are educated, civilized people. They have proved their usefulness to their companies and the society over the past 7~8 years.

So far all the arguments and suggestions were really good. But Totoro seems to be looking for compelling stories. There are very depressing cases where people had to restart their GC process for no fault of their own. And some people have been here for more than 10 years still rotting in the queue hoping to get a GC and move on with their dreams to become a Citizen of this country.
However the collective compelling story is what Eternal Hope has expressed. This is exactly the situation for people from India/China.
Sure anchor babies is not a great argument for illegals cause it promotes illegal immigration. (In fact I heard in some countries Citizenship by birth only works if the parents are legals. But thats a different story.).
Let us say because of the reasons listed by Eternal Hope we are forced to go back to our home countries.
Firstly, How fair will that be for our children who are Legit Citizens of US.
These innocent kids know only US as their home. Just as much as any other US Citizen. Most of the kids can only speak english. They can barely understand their mother tongue. Point is they are just as American as any American kid.
If they are forced to go to a foreign country, far from their friends and familiar surroundings. Had the change been for the better, still they would feel they were wronged. My guess is they will hold a grudge against us, their parents, and their own country.
This to me is compelling reason, specially since I am a Democrat (sorry can't vote yet).

So far all the arguments and suggestions were really good. But Totoro seems to be looking for compelling stories. There are very depressing cases where people had to restart their GC process for no fault of their own. And some people have been here for more than 10 years still rotting in the queue hoping to get a GC and move on with their dreams to become a Citizen of this country.
However the collective compelling story is what Eternal Hope has expressed. This is exactly the situation for people from India/China.
Sure anchor babies is not a great argument for illegals cause it promotes illegal immigration. (In fact I heard in some countries Citizenship by birth only works if the parents are legals. But thats a different story.).
Let us say because of the reasons listed by Eternal Hope we are forced to go back to our home countries.
Firstly, How fair will that be for our children who are Legit Citizens of US.
These innocent kids know only US as their home. Just as much as any other US Citizen. Most of the kids can only speak english. They can barely understand their mother tongue. Point is they are just as American as any American kid.
If they are forced to go to a foreign country, far from their friends and familiar surroundings. Had the change been for the better, still they would feel they were wronged. My guess is they will hold a grudge against us, their parents, and their own country.
This to me is compelling reason, specially since I am a Democrat (sorry can't vote yet).
BTW, my moral support has always with Obama, and with Zoe Loefgren.
Many of us cried when Obama read his oath. That was the defining moment for all people who have been subjected to injustice, been told that they were not good enough because of their race or country of origin. Think about it... The Chinese and Indians having to wait so many years just to get a GC is injustice being done to a people of certain origin. Oh well!

I wrote this keeping in mind to all people who bought houses by Mid 2008 or before
Based on comments I read on previous blog I have written �Pace of mind � do you have?� made me write this post on why Non GC holders buy houses in USA. I want to point out & clarify certain things on why & for what reasons people (Again NON GC Holders) buy houses. Below are some of categories of people who buy houses & here is why. I also pointed out � Why Non GC Holders DONOT want to buy houses� Read through & decide which category you belong to.
Category 1 : Equity
Though I do not have any data to prove my statistics I believe there are few percentage of people who buy houses only to gain Equity. These people do not care about quality of life style. They only want to target good neighborhoods or places which have good market Value & read market trends on house equity for several years. These are most of people who went with Adjustable interest back in housing market boom even though they could not afford. Their intention was only to gain profit from Equity & make some fast money. I sincerely believe most of them haven�t even cared for their Children�s career or interests. Their motto was �Buy a house now gain equity in few years before the adjustable rate ends & move on�. They do not want to think how this is going to affect their children�s life style as they have to move to new neighborhood & make new friends & get adjusted to life. I personally have known several of my friends who fall under this category & I also believe these are some of people who are partially responsible (I am saying partially because I believe Banks are the main culprits & not the individuals) for current economic crisis. A lot can be said about this category but it�s not worth my energy typing.
Categrory 2 : Affordability, Stability, Quality of life
My gut feeling says that atleast 80% or more non GC holders who bought houses fall into this category. These are people who are smart; make wise decisions, Calculate their risks before they buy the house. These are the people who do not just go & buy houses because they want it. They first look at their affordability; they even go to extent of calculating what if one of spouse looses Job & if they can still make payments. They calculate every expense & then they make a move. This is where down payment dilemma comes into picture for most. For some they go to extra mile in putting large chunk of their savings in as down payment, not because they are desperate of buying a house. Because they want to lead a good quality life style. At the same time they like everyone else they cannot predict that market will tumble in near future & that they may loose their down payments. Some choose to take this risk of paying huge chunk because they have other things in their mind. That�s is they are thinking of childrens career, stability in their life, good neighbourhood & also have to come to decision on what place / neighbourhood they want to call home going forward. That�s is one of the reason you see lot of family who has children & who are gonna have children very soon make this decision & also who are sure they are going to be able to find job in same city & not relocate incase of job lost. They also think of backup plans incase of immigration problems. These are people who are already here for several years & then decide that it is time. I believe these catergory people are victims of current market situation & somehow there is a notion out there the people who bought houses ( non GC holders ) are actually culprits of current housing market. I sincerely believe that these category people are not culprits but in fact victims of greedy bankers & some individuals who fall under category1. All these people were doing was trying to live a good quality life style for them & their family.Again I also believe these are the same smart group of people who have waited or on hold of buying a house since Mid2008 & later because of current crisis.
Remember the Quality of life style is the most important factor to be considered here. For some they get a good quality of life style in rented communities & for some in buying a house in good community. It very much depends on individual decision & quality of life style they choose to live & be able to take some calculated risks.
PS: I have seen lot of outrage & anger among the people (Non GC Holders) who bought houses . While I understand the reason behind it & I am really surprised that these category people who were just trying to lead a good life did not come to their defense when lot of people on forums blasting on why people buy houses without a GC?
Category 3 : Stupidity
Not many people but these people have no plans or action plans. They just go & buy because all of their friends are buying. They do not do any research or think about future consequences. They just want to go with flow. Actually the name of category says a lot. Do I need to say more?

Category 1: Undecided & Playing safe
These are people who want to play Safe. Fair enough!! But at the same time I want to say that they should not assume that they are no more intelligent or smarter than people who bought houses. They just want to be playing safe until they make sure that they have some kind of assurances / stability in their life. In this case Green Card. I agree with all the points these categories people make but they have to realize that most the people who bought houses have passed this Category & have come to a decision because they already lost valuable time in their part of life. It�s easy to play safe when you are in 20�s but my question is for how long & at what price? Does any know when & if they will get their actually green cards? There are some who has the time & energy who can play safe but not many people has that quality time in their life to keep playing safe. Most of them are here 8 years or more & still waiting & they are already in Mid 30�s. Yes these people will certainly wait if the govt says that you will get green in so & so year. If you look back if a family who immigrated in 2000 with a 5 year old kid almost killed their children�s career because we still haven�t come to conclusion where to settle. Satyam Employees who lost/loosing a job didn�t need a GC but so many are in the verge of loosing their homes. It�s the market conditions which is leading into these discussions. I have never heard people talking about this topic when the housing market was booming.
Just as people who bought houses respect your decision, you should also respect them on decisions they make because they chose to live a life which might be different than yours but most of them put their family first when they make these decisions & not for any material benefits.
One also has to understand that the people who bought the houses were in this category for a long time before they decided to buy a house.
Category 2: Money Money Money
These people do not want to buy houses not because they cannot afford or they want to play safe. They just don�t want to spend. All they care is Saving, Saving, saving their entire life & keep filling their bank balances. Often strangely both couples are working. These are people who want to live in cheapest rent (even with double income) in single bedroom & they don�t mind children sleeping in their bed room. They don�t mind sending their children to low grade schools. They don�t mind their in-Laws or parents when they visit sleeping in living room on the floor. Their intention to come into this country is only for earning money & because they don�t have high ambitions & all they care is saving & not spending, they just think of saving in all possible ways. They call themselves rich because of bank balances but in my view they are poor than most of homeless guys who live out streets.
Category 3: Unaffordable
They simply cannot afford due to multiple reasons like single Income, financial obligations etc.

I paper filed EAD renewal two times...took 2-3 months to get card in hand..
This time I tool chance and did efile...in 1 week (yes one week)..I see card production ordered status online..
There is no doubt about address etc..u get address on the receipt...
Hope this help..

A little over a week for me. eFile is the best option so-far. Self-reliance is far more preferable than having it done by others.

There is a huge amount of $$ you have paid for Social Security and Medicare. You don't need to get back that:confused:??. This is just a part of the benefit...
For having SSN benefits, 10 years of service is (=40 credits) required on US soil. To take those benefits you do not have to be a US citizen. Except for some countries, SSN dept can send the SS check to anywhere if mailing address is provided to it. And Green Card by definition is for "Permanent Residency" meaning as long as you renew your GC, you can be in US during your whole life time without becoming US Citizen.

I'm in a similar situation and I want to ask you if DOL withdrawn your file from the backlog center if you had a PERM application approved.
Is it Ok to have one application pending in the Backlog center and a PERM Labor certification approved if the applications are for 2 different jobs?
