Similar situation...
I am getting married in the 1st week of Sep and am planning to get my spouse by mid Sep.
Can someone please suggest if I am fine, if I apply alone for I-485 around Jul30(and not for EAD and AP??) and add my spouse around sep20th. I-140 approval is pending and have a valid visa till '08.
How long does it take for the I-485 'approval' and is 2-3 months a safe window to add ones spouse?
Any suggestions and help with my planning are greatly appreciated. :)

I think i'll get the Nikon D70
Only my opinion, Janey, but since you are moving up I wud be looking to the future. Meaning, the D70 will be a great camera for you and then you'll be eventually experimenting and wanting different/better lenses.
Canon offers IMHO far more superior lenses and more choices.
The 300D or the 10D both Canon, would be my choice.

Guys,
Finally my problem and my questions are solved.
I drove up to the Canadian Border near Niagara Falls (Buffalo), they Canaidan Border Officials took my I-94. I took a drive in canada for 10 minutes. I even stopped at spot to view the Niagara Falls from Canadian side and drove back into US. I was issued a new I-94 with out any additional interogation.
What surprised me was my Canadian Visa expired on 09/01/2007 and i was still allowed to enter into Canada.
Anyways Thank you guys for all your responses.

Good it all worked out for you. I am sure they stamped your passport on the way back into USA. Just keep track of your intrnational travel at some point it might be required, you might loose track of them if you don't have exit or entry stamps on your passport.

Thats nice pattern for EB2. It jumps almost 2 years ahead from July VB to Aug VB. Lets hope this pattern continues for 2010. Lot of EB2 folks will be happy with this pattern.

Hi all,
I have sent my application for ead renewal on 05/03 to phoenix lockbox. The application was rxd. and signed for on 05/04.
However i have not seen my checks cashed yet nor received any information from USCIS.
has anyone else experienced delays with phoenix lockbox?
What steps can i take now?

Which country in the world would lobby another country to take in its citizens? Why would India lobby America to give permanent residence to its highly skilled Indian citizens? So that America can benefit? This would be tantamount to treason.
You are not talking about H1B here. This is concerning Permanent Residence for eventual American citizenship. Think reasonably guys!

Does it make a difference ?
- If you go to Canada are you really going to be working ? You are going to go to Law School and get your degree in Law and becoming a Lawyer. So you go to Canada and study and 3+ years later become a Canadian citizen come right back in US on TN visa. Unless you don't want to abandon your Chinese citizenship.
- The July 2007 - 140 are showing signs of approval. So you get the 140 approval and then use AC21 to hang around the US and complete your Law degree in Boston. A few years later you get 485 approved and you are set in US. The complication comes is that you have a GC filed as EE and 485 might become questionable or maybe not (if you become a smart lawyer :) to defend your own)
So from the options that you stand today, if in next couple of months 140 is approved, ask your lawyer can you use AC21 and go to Law school or will there be complications. If not, stick around here.

"The applicant would no longer be eligible for H status beyond six year. Since the applicant remained in H status while waiting for his AOS adjudication, all of that time would count against the six year limit. The applicant would not be allowed to remain in the US in H status following the AOS denial because that would involve a post-six year stay" is a valid and logical point, which many of us would not have realizewd.

USCIS officially released the information that total I-485 applications which were related to July VB fiasco before August 16, 2007 were 320,000. During the period, the USCIS received 400,000 anxillary applications (EAD and AP), and substantial number of concurrent I-140 petitions. All of these figures added upto 800,000. For the USCIS verification of this information, please Q&A between the USCIS and AILA as part of the Community Relations meeting on September 25, 2007. This has been made available today.

Good to see "good news." It will take many many years for our dates to become current if there is no change in the law. So yes, it appears like some positive news, but without law being changed we are screwed anyway.
