If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . Pl. add this:
Adding / filing for Spouse's 485 should not be dependent on one's priority being current. This in turn forces the primay applicant to remain on H1b status to maintain spouse's H4.
(Above applies to those folks who got married after their primary 485 was filed but expected to remain pending due to retrogression.)
I would think that the above ties into the fact that dependents are currently being counted for visa numbers.

I agree with you but give them(EB3 people) hope that next year we will re capture unused visas either through CIR or piecemeal amendment.
With re-capture EB2 will be current and all the spillover/accross/up/down will go to EB3
and next year sept Eb3 will move 3-4 years.
I do not know much but IV core might be in a good position to answer about how we can
get our provisions piecemeal.

Assuming there are about 700 numbers available for the rest of the year 2010, using the data in the latest May-2010 I485 inventory, the calculation is pretty straight n easy with no spillover calculations involved ... here is a possible progress of the PD:

I know, especially since last year I sat around for 2 months(Aug and Sept '08) when I was current, hoping my file would be touched. What did Obama say "HOPE" ? I guess that's what we're living on. It could be a "MIRAGE" too :rolleyes:.

Thanks. That does help a lot. Once we receive the consolidated 1099 we complete the Schedule D (and D1 if there are more transactions than what can fit on Schedule D) and report the capital gains on the 1040. Correct?

I thought, 15000 members was a small goal. But I guess we have to start with even smaller goals. I agree with Amit.
There's too much at stake to give up this campaign. Without membership, we are a weak bunch. To fight organized campaigns by groups such as Numbersusa we need the member strength.
Let us aim for 8000 members by Jan 15th. Current membership stands at 7919. We need just 80 members to reach the 8000 mark. If 10% of the current membership brings ONE member by Jan 15th, we can easily reach that target. With 300000 immigrants in this kind of quagmire, cant we get 80 people? I believe we can.
Let's join hands one more time and try to Add just ONE member by Jan15th. It is for our own sakes we will be doing it, so let's do it!!!

Just 2 simple things...
1, Green card to anyone who has been employed in the US for 5 Consecutive years( can provide W2 for the past 5 years)
2, Citizenship for someone who has been in the US for 10 years.
1.1, Once this provision kicks in normal approval within a specific time frame. say 6/12 months.
1.2, They can also tie the 5 GC years with some minimum salary/prevailing age with region of employment.
Advantages to us..
- Removes all the stuff to do with country impartiality.
- Makes us independent of employer.
- Makes us competitive.
Advantages for them..
- Simple
- Provides proof that the individual has been productive to the economy/country in the past.
- They may wanna tie Citizenship with the 40 Credits from Social Security or something if that helps.
- Removes loopholes which assists in driving down wages as employee would like to make sure he is employed enough to meet the prevailing wage for the year. (Drive the complain that we bring down rates etc)
There might be more advantages, but I just wrote down a few.

Somebody left me a message to answer this so I am jumping in. Let me know if my answer seems reasonable.
1) EB2 ROW is not 48K .... it is about 69K (ROW = all countries except IC).
2) EB2 ROW will add average 30K to this inventory.... so lets say in this economy they add 15-20K. So what EB2ROW has consumed is about 20-25K until today out of the 42K avlbl for the entire category and 36K for ROW EB3.
3) Tll jun 04 there are about 9K cases more left. So that will just about bring EB3ROW to 30-35K annual consumption - same as its quota.
Will the dates for EB3ROW move beyond Jun 04? May be Dec 04 max. The chances of movng it beyond that are less.
In other words .... the visas are NOT being utilized anywhere else. Its just the consumption is high.

If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

Good that you took it in the right spirit. All the efforts you are trying for us are inline with what even I wanted to do, but dont have as much access as you do. Search the forums with my id and you will see for yourself. To my knowledge there are very few who can do what you are doing. I wish Moderators and IV Core endorse your efforts in the form of a campaign and you will see much more participation. Look at the other drive they are doing for create a fund of $10000.00 If they endorse you (thats we) will get response in that order. Can you please ask Aman to do that, and that way we will have more voice.

Not sure why most of you, even senior guys(by join date, and not by # of posts) just rememer the $3500 part all the time with my name :) but miss what we said. Go n read it again.And if Core endorses does effort, I will not be surprised if there will be contribution from as much as 5000 members each of $100 on avg= $500,000. No kidding, thats the pain EB3 is facing.. Anyone to disagree??.

Tell me the secret how you get that much time(I am begging for few extra hrs in last 1 month), but only in case you have a job. Else we know.

I is only based on a law. In the past CIS used the law to implement one set of policy (horizontal spill over). Since the middle of 2008 CIS is using the same exact set of laws to implement a different set of policy (vertical spill over).
They can interpret the law how the language was used in the legislation as well as what congress intended to do. Any way, before 2000, INA clearly enforce the veritcal spill over in EB catagories. After year 2000 (after AC21 amendment to INA) INA was modified to horizontal spillover. DOS did not noticed this change till 2007. Only after 2007 (after AILA&congress efforts) DOS paid the attention to the law change and exactly following the law. Till that point EB3 was benefitted. One of the purpose of AC21 law is, to remove country quota in EB catagories. The intension is, becuse of 7% country limitation, american competiveness should not be affected (to eliminate the limitation of the high skilled immigrants from oversubscribed countries in higer catagory).

What do you think guys? If he receives tons of e-mails and phone calls regarding this, he may try to re-introduce again. I just sent an email to him from his website: kerry.senate.gov
