Hello,
My cousin H1-B has been selected in the lottery, so her H1-B is in process for this year, but her husband's H1-B was approved last year, so he is planning to get H1-B stamped and come here. If she waits for her H1-B to get approved and come then it will be sometime the end of this year. Is it possible that she can come here on H-4 visa while her H1-B is still in process? Need urgent help on this. She has never been to US.

My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.
My questions are:
1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?
2- What documents are required to file for EAD besides what is already being sent with the I-485?
3- What are the potential problems in leaving the country in July with an I-485 (with or without EAD, please tell me in both cases) submitted, and having a visa appointment at the consulate abroad in August to renew my h4 that expires in NOv 2007? Why does IV prefer Recurring contributions..? to one time contributions?

I am very confused. First they retrogress and then they make it unavailable. How could they be in the dark with regards to the number of "approvable" applications!!!:mad:
The fact remains that there is no structured information available to anyone (even USCIS or DOS themselves) on Priority Dates. It is nothing more than a date written in ink on paper applications. Cutoff date movements are purely based on guess work. Centers work on cases in order they physically receive them (irrespective of their PD's). While approving if they find PD is not current, case is put aside and next one is taken up. In the past cutoff dates in July-Sep period were moved forward so that "put aside" are minimized (thereby maximizing efficiency), else their bosses will question for not using all visas.
Systems are not designed for managing cases based on PD's, hence the hotch potch we see.

Just cooking up stuff classifies as a multi national.I know a guy who is a business analyst on L1 visa got his GC in 6 months time in EB1 category by a well know consulting company stating him as a Manager..The guy was bragging and showing off his white card ,and telling how he got his GC in 6 months

Very true - anyone who goes ahead in the queue is actually easing it up for the latter. This is Never about belittling a fellow sufferer.
If PhDs get a quota relief, will be good for all of us, although i personally will not qualify.
US Bachelors/Masters holders in a STEM field for example, will similarly ease up the system.
Hopefully all others will see it that way.

USCIS has already made everything 'U', starting with August and this year's quota is finished. Also now they have a little advantage that everyone who can file I-485 will file it. They now have all the applications and all the numbers to calculate for next few years.
Don't you guys think that the USCIS will probably keep on moving the dates by as much only to accomodate the quota numbers.
Also, BEC has targetted Sep '07 to clear all labor backlogs and new I-485 approvals won't start before Oct '07. Older PDs will (as they always had) have golden value.
Once bitten twice shy, USCIS will not make the mistake of making dates 'C' in a long time.
2006-07 filers have intermittent releif of EADs which BEC or pre-PERMs never dreamt of :) (that includes me)
This is what looks logical and this will do justice to all.

I have an approved labor cert thru PERM(PD: July 2006). The advertisements were made in May.
I also have a pending TR case in DBEC(PD: Aug 2002). I'm planning to have it converted to RIR. Would anyone know if I can use the same advertisement efforts that were used in the PERM case, as basis for the TR to RIR conversion?

Life has lots of other issues,so while the GC is important it cannot and should not come before all other problems in life. Talk to the people who have been diagnosed with cancer or something else and have been told that they will live 6 months at the most, you'll understand what priorities in life are.
I do wish it was Friday today then could have downed a few pegs tonight :rolleyes:

The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

I am a strong supporter of IV , its cause and one of the state chapter leaders . And I also believe that IV's goal should be clear and focussed, but this is an issue that eats my heart.
What kind of justice it is, where people are rewarded for breaking laws and those who followed it are made to suffer.
We are here in the US not only for ourselves but also for the better life to our children. If we can't give them that then our living in this country is worthless.
I also think that this issue should be part of IV top agenda among other things. The folks in question are not illegal but our very own in EB category. They are the greatest victim of the system. When I look at my sufferings , it is less compared to what these people are going through. My green card may be delayed but most likely will not be denied. Whereas, their green card is as good as denied.
While I am writting this and putting myself in your shoes, I feel helpless and hopeless. If IVians won't help here then who would?

Going back to the original subject of discussion - before the thread got hijacked by plainspeak and some really divisive and dangerous viewpoints - I just wanted to say I completely agree with Goodintentions and the post below. Thanks for the observations - certainly helps newer members who are getting used to the idea of meeting congressional offices. This bill helps all EB and we should be all for it and any other piecemeal bills coming up in the new Congress

Thanks for signing up. The good part about these events is they are both Walking and running events so newbies should not hesitate to Join. We picked an event in Houston because Texas had the second highest number of letters for the Admin Fix campaign :)
I am in - along with my husband (and he is going to kill me for signing him up ...he he) for the Houston 5K run - lets start with that and see if I can finish..I'll take on more if I have success with this!
BTW, there is also a kids run for children ages 5 to 15 (K - 8) - my kids won't qualify for it, but those that have kids in this age group can truly train as a family.

The Murray Amendment failed to make it through in the Senate Appropriations bill due to strong opposition from some senators for adding domestic issues with a war funding bill. The amendment wasn't defeated by vote, it was just that it was in the wrong place at the wrong time.
The house bills HR 5882, 5921 and 6039 is gathering good momentum. Please call your own lawmakers, CHC members and the list of lawmakers which IV wants to call. Please call and ask them to co-sponsor these bipartisan bills
